Lastly, the Bourke petitioners posed to the Court two inquiries: whether or not a condition violates the Due Process or Equal Protection Clauses of the Fourteenth Amendment by prohibiting same-sex partners to marry, and regardless of whether it does so by refusing to recognize out-of-condition exact same-intercourse marriages.
