On sixteen October 2012, the United States Court of Appeals for the District of Columbia Circuit vacated Hamdan's conviction, on the grounds that the functions he was billed with underneath the Military Commissions Act of 2006 were being not, in truth, crimes at the time he dedicated them, rendering it an ex publish facto prosecution.
